General Terms and Conditions of Luba Moden

§1 Applicability to entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
(2) A consumer is any natural person who enters into a legal transaction for purposes which are predominantly neither attributable to their commercial nor their independent professional activity (Section 13 of the German Civil Code).

§2 Formation of a contract, storage of the contract text

(1) The following provisions regarding the conclusion of contracts apply to orders placed via our online shop https://lubamoden.de .
(2) In the event of a contract being concluded, the contract shall be with Luba Moden Lubow, Otto Riehlstr. 11, D-14057 Berlin came about.
(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase agreement.
(4) Upon receipt of an order in our online shop, the following provisions shall apply: The consumer submits a binding offer to enter into a contract by successfully completing the order procedure provided in our online shop.

The order process consists of the following steps:
Before submitting the order, the customer can review their information and correct any errors by clicking the "Back" button in their web browser. Alternatively, they can cancel the order process by closing the browser. We will immediately confirm receipt of the order with an automatically generated email ("Order Confirmation"). This email constitutes our acceptance of your offer.

(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order details and our Terms and Conditions by email. You can also view the Terms and Conditions at any time at https://lubamoden.de/pages/agb. You can view your past orders in our customer area under My Account --> My Orders.

§3 Prices, shipping costs, payment, due date

(1) The prices quoted include statutory VAT and other price components. Shipping costs may be added.
(2) The consumer has the option of paying via PayPal, credit card (Visa, Mastercard, American Express).

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment. Delivery will take place within 5 working days at the latest. The delivery period begins, in the case of payment in advance, on the day after the payment order is issued to the bank responsible for the transfer, and in the case of all other payment methods, on the day after the contract is concluded. If the last day of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next working day.
(2) In the case of a sale involving shipment, the risk of accidental loss or accidental damage to the goods sold shall not pass to the buyer until the goods are handed over to the buyer.

§5 Retention of Title

We retain ownership of the goods until the purchase price has been paid in full.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but this is not obligatory.

Consequences of revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

We may refuse reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
